Terms of Service

Please read these Terms of Service carefully before using the Inspect IT platform.

The Inspect IT platform, website, web application and mobile applications are operated by Inspect IT. The Inspect IT platform, including the web portal, mobile apps, APIs, inspection tools, reporting tools, AI features and related services, are referred to in these Terms as the “Services”.

You, as a user of the Services, are responsible for your use of the Services and for any content, inspection data, reports, media, tasks, comments or other information submitted through the Services.

1. Introduction

These Terms of Service set out the rules governing:

1.1 The use of the website at https://inspectit.eu, the web application at https://app.inspectit.eu, any related portal, API, successor website or related service made available by Inspect IT.

1.2 The use of Inspect IT mobile applications and web applications used for inspections, asset checks, maintenance workflows, evidence capture, reporting, communication and task management.

1.3 The upload, transmission, storage, processing and use of content by you, your organisation or any person acting on your behalf through the Services.

1.4 The use of AI-supported features within Inspect IT, including AI-assisted inspection notes, summaries, report drafts, task suggestions, image analysis, transcription, classification or other automated support features.

References in these Terms to “you” mean any customer, organisation, administrator, inspector, contractor, employee, user or other person accessing or using the Services.

References to “Inspect IT”, “we”, “us” or “our” mean Inspect IT.

By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organisation, you confirm that you have authority to accept these Terms on behalf of that organisation.    

   
2. Use of the Services

You must use the Services only for lawful business purposes and in accordance with these Terms.

You must not use the Services in any way that causes, or may cause, damage to the Services or impairment of the availability, security, performance or accessibility of the Services.

You must not use the Services:

2.1 In any way that is unlawful, illegal, fraudulent, deceptive or harmful.

2.2 In connection with any unlawful, illegal, fraudulent, deceptive or harmful purpose or activity.

2.3 To upload, store, process or transmit any content that breaches these Terms.

2.4 To interfere with, disrupt or attempt to gain unauthorised access to the Services, systems, servers, accounts, data or networks connected to the Services.

2.5 To attempt to bypass authentication, permissions, role controls, subscription limits, technical restrictions or security protections.

2.6 To reverse engineer, modify, copy, transfer, sell, resell, distribute, decompile or disassemble any software, code, data, information or material made available through the Services.

2.7 To impersonate another person, organisation or account.

2.8 To harass, threaten, abuse, intimidate or mislead other users.

2.9 To submit false, misleading or fabricated inspection records, evidence, reports or compliance information.

You are responsible for your account, your users, your devices, your inspection data and all activity carried out under your organisation’s access to the Services.

    

3. Intended purpose

Inspect IT is designed to help users create, manage and review inspections, reports, assets, equipment records, maintenance tasks, work orders, expenses, evidence, communication and related operational workflows.

You agree to use the Services for their intended purpose only.

You acknowledge that Inspect IT is a support platform. It does not replace professional judgement, legal advice, engineering advice, safety advice, surveyor advice, compliance advice or any other specialist assessment required by law or good professional practice.

You remain responsible for reviewing, approving and relying on any inspection output, report, recommendation, task, summary or AI-assisted result created through the Services.

    

4. Accounts and access

You must ensure that all account information you provide is accurate, current and complete.

You must keep your login details secure and confidential.

You must not share your login details with unauthorised persons.

You must tell us promptly if you become aware of any unauthorised access to your account or organisation.

Administrators are responsible for managing users, roles, permissions and access rights within their organisation.

You are responsible for removing access for users who no longer require access to the Services.

We may suspend or restrict access to the Services if we reasonably believe that an account has been compromised, misused or used in breach of these Terms.

     

5. Customer content

“Customer Content” means any data, text, photographs, videos, audio recordings, documents, inspection forms, reports, comments, signatures, asset records, maintenance records, expenses, files, templates, task data or other material uploaded, generated, submitted or stored by you through the Services.

You retain ownership of your Customer Content.

You grant Inspect IT a limited licence to host, store, process, display, transmit, back up and use Customer Content only as needed to provide, secure, maintain, improve and support the Services.

You are responsible for ensuring that your Customer Content is accurate, lawful and appropriate.

You must ensure that you have the right to upload, use and share any Customer Content submitted through the Services.

You must not upload Customer Content that infringes any third party rights, breaches confidentiality, breaches privacy, breaches data protection law or causes legal liability.

    

6. Inspection data and reports

Inspect IT may help you capture, organise and generate inspection reports and related outputs.

You are responsible for checking all inspection reports before sharing, submitting or relying on them.

You must ensure that all inspection findings, risk ratings, evidence, notes, images, signatures and conclusions are accurate and complete before final approval.

You acknowledge that inspection reports may affect safety actions, repairs, deposits, budgets, compliance, maintenance decisions, legal claims or operational decisions.

Inspect IT does not accept responsibility for decisions made from unchecked, incomplete, inaccurate or unapproved inspection data.

    

7. AI-assisted features

Inspect IT may include AI-supported features that help create summaries, detect issues, draft report text, extract information from images or documents, transcribe audio, classify findings, suggest tasks or support inspection workflows.

AI outputs are provided as drafts or assistance only.

You must review, edit, approve or reject AI-generated outputs before using them in a final report, task, communication, record or decision.

You must not rely on AI outputs as professional advice, safety advice, compliance advice, legal advice or a final inspection conclusion.

You are responsible for the final content and use of any AI-assisted output.

We may improve, modify or remove AI features over time.

   

8. Unlawful content

Customer Content must not be illegal or unlawful, must not infringe any person’s legal rights and must not be capable of giving rise to legal action against any person.

Customer Content must not:

8.1 Be libellous, defamatory or maliciously false.

8.2 Be obscene, indecent, pornographic or sexually explicit.

8.3 Infringe copyright, moral rights, database rights, trade mark rights, design rights or other intellectual property rights.

8.4 Infringe privacy rights, confidentiality rights or data protection rights.

8.5 Contain negligent, reckless or knowingly false statements.

8.6 Encourage or assist criminal activity.

8.7 Breach any court order or legal restriction.

8.8 Promote hatred, discrimination, harassment or abuse.

8.9 Breach any contractual obligation owed to another person or organisation.

8.10 Contain official secrets, restricted information or confidential information that you are not authorised to process.

You must ensure that Customer Content is not subject to any threatened or actual legal proceedings or complaint.

  

9. Graphic material

Customer Content must be appropriate for the people who are authorised to access it.

Customer Content must not depict violence in an explicit, graphic or gratuitous manner unless it is strictly necessary for a lawful inspection, safety, insurance, compliance or incident reporting purpose.

Customer Content must not be pornographic or sexually explicit.

  

10. Factual accuracy

Customer Content must not be knowingly untrue, false, inaccurate or misleading.

Statements of fact contained in Customer Content must be true to the best of your knowledge.

Statements of opinion contained in Customer Content must be honestly held, reasonable and supported by the available inspection evidence where relevant.

  

11. Dangerous or negligent advice

Customer Content must not contain instructions, advice or information that may cause death, illness, personal injury, property damage or other loss if acted upon, unless it is provided by a suitably qualified person and used for a lawful inspection, maintenance, compliance, safety or operational purpose.

You are responsible for ensuring that safety-critical, engineering-critical, compliance-critical or legally sensitive outputs are reviewed by a competent person before use.

  

12. Marketing and spam

You must not use the Services to send spam or unlawful marketing communications.

You must not use contact details available through the Services for unsolicited marketing.

You must not use the Services to promote, host or operate chain letters, Ponzi schemes, pyramid schemes, multi-level marketing schemes, “get rich quick” schemes or similar activities.

You must not use the Services in any way that may result in the blacklisting of any Inspect IT IP address, domain, mail server or service provider.

  

13. Regulated and prohibited activities

You must not use the Services for any purpose relating to:

13.1 Gambling, betting, lotteries, sweepstakes or gambling-related activity.

13.2 The sale or distribution of illegal drugs or unauthorised pharmaceuticals.

13.3 The sale or distribution of weapons.

13.4 Fraud, money laundering or unlawful financial activity.

13.5 Surveillance, tracking or monitoring of people where this would be unlawful.

This does not prevent lawful inspections of regulated premises, assets, equipment or facilities where you have the legal right and professional authority to conduct that work.

  

14. Monitoring and enforcement

We do not actively monitor all Customer Content submitted through the Services.

We may review, remove, restrict or block Customer Content if we reasonably believe it breaches these Terms, creates a security risk, creates legal risk or may harm the Services or other users.

We may suspend or terminate access if you breach these Terms or misuse the Services.

   

15. Data mining and automated access

You must not conduct systematic or automated scraping, data mining, data extraction, data harvesting or other automated data collection activity in relation to the Services, except through an API or integration expressly made available by Inspect IT for that purpose.

You must not use bots, crawlers, scripts or automated tools to access the Services without our written permission.

We may apply rate limits, throttling, access restrictions or technical controls to protect the Services.

   

16. Hyperlinks and external content

You must not use the Services to link to material that would breach these Terms if it were uploaded directly to the Services.

The Services may contain links to third-party websites, tools, maps, integrations, file stores, payment providers or other external services.

We are not responsible for third-party websites, services, content, policies or practices.

  

17. Harmful software

Customer Content must not contain viruses, worms, spyware, adware, ransomware, malware or other harmful software, code, files, programs, routines, applications or technologies.

You must not use the Services to upload, distribute, execute or promote software or content that may damage, disrupt, overload, access or interfere with any computer, device, server, network or data.

  

18. Intellectual property

You do not own the Services, software, platform, applications, APIs, designs, workflows, code, databases, templates, user interface, documentation, branding or related intellectual property made available by Inspect IT.

All rights in the Services and related intellectual property are owned by Inspect IT or its licensors.

The licence to access and use the Services does not grant you ownership of any intellectual property in the Services.

You must not copy, reproduce, sell, license, modify, adapt, distribute or create derivative works from the Services without our written permission.

For clarity, Inspect IT does not claim ownership of Customer Content created or uploaded by you.

  

19. Templates and configuration

Inspect IT may allow you to create, edit, import, export or use inspection templates, checklists, workflows, forms, reports, roles and automations.

You are responsible for checking that templates, workflows and reports are suitable for your use case, industry, jurisdiction and organisation.

Any sample templates, demo templates or example workflows are provided for general guidance only.

    

20. Integrations and third-party services

The Services may integrate with third-party systems, tools, APIs, cloud services, authentication providers, payment providers, storage providers, mapping services, email services or communication tools.

Your use of third-party services may be subject to separate terms and privacy policies.

We are not responsible for third-party service availability, performance, security, errors, pricing, data handling or changes.

We may add, change or remove integrations over time.

  

21. Subscription, payment and access

Certain parts of the Services may require a paid subscription, licence, trial or agreed commercial arrangement.

You must pay all fees agreed with Inspect IT in accordance with the relevant order form, invoice, subscription plan or commercial agreement.

Access may be limited, suspended or terminated if payment is late, a trial expires or a subscription ends.

Unless agreed otherwise in writing, fees are non-refundable.

We may change pricing, plans or included features by giving reasonable notice where required.

   

22. Trials and pilot use

Inspect IT may offer free trials, pilot access or temporary evaluation access.

Trial or pilot access may be limited in time, features, users, storage, reports, templates, AI usage or support.

We may end or restrict trial or pilot access at any time.

You remain responsible for all content and decisions made during a trial or pilot.

  

23. Service availability and updates

We aim to keep the Services available and reliable, but we do not guarantee uninterrupted access.

The Services may be unavailable due to maintenance, updates, security work, technical issues, third party service problems or events outside our control.

From time to time, we may update, modify, improve, remove or replace parts of the Services.

Continued use of the Services may depend on installing updates, using supported browsers, using supported devices or keeping mobile applications up to date.

  

24. No warranty

The Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Inspect IT gives no warranty that:

24.1 The Services will be uninterrupted, error-free or available at all times.

24.2 The Services will meet every requirement, industry standard or specific use case.

24.3 The Services, reports, AI outputs, dashboards, analytics or data will be complete, accurate or suitable for a particular purpose.

24.4 Any defect, issue or vulnerability will be corrected immediately.

24.5 Any third-party website, app store, integration or service will be free from viruses, malicious code or security risks.

Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.

  

25. Limitation of liability

To the fullest extent permitted by law, Inspect IT will not be liable for any indirect, incidental, special, consequential or punitive loss or damage.

This includes loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data, loss of opportunity, business interruption, reputational damage or cost of substitute services.

Inspect IT is not responsible for loss or damage caused by:

25.1 Your misuse of the Services.

25.2 Inaccurate, incomplete or unlawful Customer Content.

25.3 Failure to review inspection reports, AI outputs, tasks or recommendations.

25.4 User error, incorrect permissions or unauthorised account access.

25.5 Third-party services, integrations, networks, devices, app stores or hosting providers.

25.6 Events outside our reasonable control.

Nothing in these Terms limits liability where it cannot legally be limited.

  

26. Indemnity

You agree to indemnify and hold Inspect IT harmless from any claim, loss, liability, damage, cost or expense arising from:

26.1 Your breach of these Terms.

26.2 Your misuse of the Services.

26.3 Your Customer Content.

26.4 Your breach of law, regulation, third party rights, confidentiality, privacy or data protection obligations.

26.5 Any inspection report, task, decision or action created, approved, shared or relied on by you.

  

27. Privacy and data protection

Your use of the Services may involve the processing of personal data.

You must ensure that you have a lawful basis for collecting, uploading, storing, processing and sharing personal data through the Services.

You are responsible for ensuring that your use of the Services complies with applicable data protection laws.

Inspect IT may process personal data to provide, secure, maintain, support and improve the Services.

Inspect IT may collect information about how the Services are used. This may include device information, account information, usage logs, feature usage, error logs, access times, browser information, app information and technical diagnostics.

We will handle personal data in accordance with our Privacy Policy.

  

28. Confidentiality

You may access confidential information through the Services.

You must keep confidential information secure and must not disclose it except where authorised or required by law.

Confidential information may include inspection records, reports, property data, asset data, customer data, user data, pricing, product information, security information, business information and technical information.

  

29. Data retention and deletion

Customer Content may be retained for as long as required to provide the Services, meet legal obligations, resolve disputes, maintain security, support backups or comply with agreed retention settings.

You may request deletion or export of Customer Content where supported by the Services or required by law.

Backups may remain for a limited period after deletion as part of normal backup and disaster recovery processes.

We may delete Customer Content after account closure, subscription expiry or termination, subject to applicable law and any written agreement.

  

30. Suspension and termination

We may suspend or terminate your access to the Services if:

30.1 You breach these Terms.

30.2 You fail to pay applicable fees.

30.3 You misuse the Services.

30.4 Your use creates a security, legal or operational risk.

30.5 We are required to do so by law.

30.6 Your account has been inactive for a long period.

You may stop using the Services at any time.

Termination does not affect rights, obligations or liabilities that arose before termination.

  

31. Changes to these Terms

We may update these Terms from time to time.

When we make material changes, we may notify users by email, through the Services or by updating the date at the top of this page.

Your continued use of the Services after changes take effect means you accept the updated Terms.

  

32. Severability

If any part of these Terms is determined to be invalid, unlawful or unenforceable, that part will be removed or limited to the minimum extent required.

The remaining parts of these Terms will continue to be valid and enforceable.

  

33. Governing law and disputes

These Terms are governed by the laws of Estonia, unless mandatory local law provides otherwise.

Any dispute arising from these Terms or the Services will be handled by the competent courts of Estonia, unless mandatory law requires another forum.
